AZ Judge Upholds Education Savings Accounts

A Maricopa County Judge is upholding the constitutionality of Arizona’s educational savings account program.

Plaintiffs had gone to court to overturn the law passed in early 2011, which allowed the Arizona Department of Education to disburse public funds as scholarships which parents could use to pay for tuition at private schools.

They argued the money would “aid” private religious schools which has been struck down by Arizona courts.

However, the Superior Court held Wednesday that it was parents who were exercising control over the funds and where the money would go so the law did not violate the constitution.

An appeal is expected.
